Website Terms of Use
Effective date: 1 September 2026
These Terms govern only use of the Firm’s general marketing website. They do not govern, vary or replace any client engagement, letter of engagement, retainer or terms of business.
1. About these Terms
These Terms of Use apply when you access or use www.tkp.com.my (the “Site”), operated by Tai & Khan Partnership, a Malaysian law firm at No. 36A, Jalan SS 21/58, Damansara Utama, 47400 Petaling Jaya, Selangor, Malaysia (“we”, “us” or the “Firm”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
The Site provides general information about the Firm and its services. These Terms apply only to the Site and do not govern any solicitor-client engagement. Any engagement is subject to a separate written agreement accepted by the Firm and the client.
2. Acceptable use
You may use the Site only for lawful purposes. You must not:
- interfere with, disrupt, damage or attempt to gain unauthorised access to the Site, its server, accounts or connected systems;
- introduce malware, malicious code, automated attacks or excessive requests;
- use the Site to commit fraud, impersonate another person, infringe rights or breach any law;
- copy, scrape, extract or systematically reuse substantial parts of the Site except with our prior written permission or as allowed by law; or
- misrepresent Site content as advice, an official legal opinion or content endorsed by the Firm for a different purpose.
We may restrict or block access where reasonably necessary to protect the Site, users, the Firm or third parties.
3. Intellectual property
Unless stated otherwise, the Site and its text, design, graphics, logos, photographs, software and other content are owned by or licensed to Tai & Khan Partnership and are protected by applicable intellectual-property laws.
You may view and print reasonable extracts for your personal, non-commercial information. You may not reproduce, modify, publish, distribute, sell, license, remove notices from, or create derivative works from Site content without our prior written permission, except as permitted by law. Third-party names, marks and materials remain the property of their respective owners.
4. No legal advice and no solicitor-client relationship
Nothing on the Site is legal advice. The content is general information only, may not be complete or current, and may not apply to your facts. You should obtain advice from a qualified lawyer who has considered your specific circumstances before acting or refraining from acting.
Using the Site, sending us a message, submitting an enquiry, or receiving an automated or preliminary response does not create a solicitor-client relationship, duty of care, retainer or obligation for the Firm to act. A solicitor-client relationship is created only when the Firm has completed its acceptance procedures, including conflict and other checks, and both sides have agreed to a written engagement.
Do not send confidential, privileged, urgent or time-sensitive information through the Site unless and until we have confirmed in writing that we act for you and have approved that communication method.
5. Availability and accuracy
We aim to keep the Site available and useful, but we do not guarantee that it will always be available, secure, error-free or free of harmful components. We may change, suspend or withdraw any part of the Site without notice.
To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis without warranties, representations or guarantees, whether express or implied. We do not warrant that content is complete, accurate, current or suitable for any particular purpose.
6. External links
The Site may link to websites, services or materials operated by third parties. We do not control or endorse them and are not responsible for their content, availability, security, privacy practices or terms. You access third-party resources at your own risk and should review their terms and privacy notices.
7. Limitation of liability
To the fullest extent permitted by Malaysian law, Tai & Khan Partnership, its partners, employees and representatives will not be liable for loss or damage arising from or connected with your use of, inability to use, or reliance on the Site or its content, including indirect, consequential or economic loss, loss of data, loss of opportunity or business interruption.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
8. Privacy
Our handling of personal data connected with the Site is described in our Personal Data Protection Notice. These Terms do not replace that Notice.
9. Changes to the Site or these Terms
We may update these Terms from time to time. The updated version will be posted on the Site with a revised effective date. Your continued use of the Site after an update means you accept the updated Terms, to the extent permitted by law.
10. Governing law and jurisdiction
These Terms and any non-contractual obligations connected with them are governed by the laws of Malaysia. The courts of Malaysia will have non-exclusive jurisdiction, subject to any mandatory law that applies.
